Bail and Bonds: The Complete Framework (Sections 478 to 496 BNSS)
The principle that “Bail is the rule, jail is an exception” forms the bedrock of criminal jurisprudence, rooted in Article 21 of the Constitution. Under the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, the provisions relating to bail have been modernized and consolidated under Sections 478 to 496.
While the core philosophy remains, the BNSS introduces strict new timelines, relief for first-time offenders, and tighter restrictions on repeat offenders.
1. Regular Bail: Bailable vs. Non-Bailable
Bailable Offences (Section 478 BNSS)
Corresponds to Section 436 CrPC.
- The Right: In bailable offences, bail is an absolute and indefeasible right. The police officer or the Court shall release the accused on bail.
- The “Indigency” Clause: If a person cannot furnish a financial surety within one week of their arrest, the court must presume they are indigent (poor) and release them on a personal bond (without monetary surety).
Non-Bailable Offences (Section 480 BNSS)
Corresponds to Section 437 CrPC.
- The Discretion: Bail is not a right here; it is a matter of judicial discretion.
- The Restriction: A Magistrate cannot grant bail if there are reasonable grounds to believe the accused committed an offence punishable with death or life imprisonment.
- The Exceptions: Even in heinous crimes, a Magistrate can grant bail if the accused is a woman, a minor (under 18 years), sick, or infirm.
2. Default / Statutory Bail (Section 187 BNSS)
This section (formerly 167(2) CrPC) acts as a strict check on police delays. If the investigating agency fails to file the charge sheet within the statutory timeline, the accused earns an “indefeasible right” to be released.
- 90 Days: For offences punishable with death, life imprisonment, or imprisonment for 10 years or more.
- 60 Days: For all other offences.
Key BNSS Change: Under the old law, the maximum 15 days of police custody (remand) had to be taken immediately after arrest. Under Section 187(3) of the BNSS, these 15 days can now be staggered and sought in parts across the initial 40 days or 60 days of detention.
3. Undertrials & First-Time Offenders (Section 479)
This section replaces Section 436A CrPC and introduces a massive reform to decongest prisons.
- The 1/2 Rule: If an undertrial prisoner has spent half of the maximum prescribed sentence for their alleged crime in custody, the Jail Superintendent must apply for their release.
- The 1/3 Rule (New): If the accused is a first-time offender (never convicted before), they must be released on bail after serving just one-third (1/3) of the maximum sentence.
- The Exception: These early release provisions do not apply to offences punishable by life imprisonment/death, or if the accused has multiple pending cases against them.
